Terms of Service

1. Who May Use Our Services

You must be at least 13 years old to use our services unless a particular app clearly states otherwise.

If you are under the legal age of adulthood where you live, a parent or legal guardian must approve your use of the service.

If you use a PutesLabs service for a business or organization, you confirm that you have permission to act on behalf of that business or organization.

2. Accounts

Some services may require you to create an account.

You agree to provide accurate information and keep your login information secure. You are responsible for activity that occurs through your account.

You may not:

• Create an account using false information;
• Pretend to be another person or business;
• Access another person's account without permission;
• Sell or transfer your account; or
• Use an account for unlawful or abusive purposes.

Please contact hello@puteslabs.com if you believe someone has accessed your account without permission.

3. Permission to Use Our Services

PutesLabs gives you a limited, personal, non-exclusive, and revocable right to use our services for their intended purposes.

Our applications are licensed to you, not sold to you.

You may not:

• Copy, resell, or redistribute our applications;
• Reverse engineer or attempt to discover our source code;
• Bypass subscriptions, security systems, or usage limits;
• Interfere with the operation of our services;
• Use automated tools to scrape or overload our services;
• Remove ownership or copyright notices; or
• Use our apps to create a competing product by copying their design or features.

PutesLabs retains ownership of its applications, software, branding, designs, content, and technology.

4. Acceptable Use

You agree not to use our services to:

• Break any law;
• Commit fraud or deceive another person;
• Harass, threaten, or harm another person;
• Upload viruses, malware, or harmful software;
• Violate another person's privacy;
• Infringe copyrights, trademarks, or other rights;
• Upload content you do not have permission to use;
• Collect personal information without permission;
• Send spam or unauthorized advertising;
• Attempt to gain unauthorized access to an account or system; or
• Use the service in a way that could harm PutesLabs, our users, or another person.

We may investigate suspected misuse and may restrict or suspend access when reasonably necessary.

5. Content You Upload

Some PutesLabs apps may allow you to upload photographs, videos, files, notes, job information, client information, messages, or other content ("User Content").

You continue to own your User Content.

By uploading User Content, you give PutesLabs permission to store, process, display, back up, and transmit it only as reasonably necessary to operate and improve the service.

You confirm that:

• You own the content or have permission to use it;
• The content does not violate another person's rights;
• You have permission to upload information about another person; and
• The content does not violate these Terms or applicable law.

You are responsible for the content you upload.

We do not claim ownership of your private content and will not use private User Content in advertising without your permission.

We may remove content that we reasonably believe is unlawful, harmful, infringing, fraudulent, or in violation of these Terms.

6. Information About Other People

Some PutesLabs apps may allow you to enter information about customers, clients, employees, properties, jobs, or appointments.

You are responsible for making sure you have permission and a lawful reason to collect, upload, and use that information.

Do not upload highly sensitive information unless the app is specifically designed to process it.

7. Purchases and Subscriptions

Some services may offer paid features, subscriptions, or in-app purchases.

Prices and subscription terms will be shown before you complete a purchase.

Subscriptions may automatically renew unless canceled before the next billing date. The price, billing frequency, and renewal terms will be shown when you subscribe.

Purchases made through the Apple App Store are processed by Apple. Purchases made through Google Play are processed by Google.

You must manage or cancel an app-store subscription through the Apple or Google account used to purchase it.

Deleting an app or deleting your PutesLabs account may not automatically cancel an active subscription.

Unless required by law or the applicable app store's rules, payments are generally non-refundable. After cancellation, you may continue using paid features until the end of the current billing period.

We may change prices for future billing periods. When required, we will provide notice before a new price takes effect.

8. Third-Party Services

Our services may use or connect to third-party services, including:

• Apple;
• Google;
• Payment processors;
• Cloud-storage providers;
• Authentication providers;
• Analytics services;
• Maps;
• Artificial-intelligence providers; and
• Other websites or applications.

Third-party services have their own terms and privacy policies.

PutesLabs does not control and is not responsible for the availability, security, content, pricing, or actions of independent third-party services.

9. Artificial Intelligence Features

Some PutesLabs services may include artificial-intelligence features.

AI-generated information may be inaccurate, incomplete, outdated, or unsuitable for your situation. You are responsible for reviewing AI-generated results before relying on, publishing, or using them.

AI-generated results are not professional legal, medical, financial, tax, or other licensed advice.

Do not submit confidential or highly sensitive information to an AI feature unless the app clearly states that it is designed to process that information.

10. Service Availability and Changes

We work to keep our services available and functioning properly, but we cannot guarantee uninterrupted or error-free access.

We may:

• Fix or update an app;
• Add, modify, or remove features;
• Change technical requirements;
• Limit usage or storage;
• Suspend a feature for security reasons; or
• Discontinue an app or service.

We may provide notice before making major changes when reasonably practical.

You are responsible for keeping separate backups of important files and information. A PutesLabs service should not be your only storage location for important content.

11. Disclaimer of Warranties

To the fullest extent permitted by law, our services are provided "as is" and "as available."

We do not guarantee that:

• A service will always be available;
• Every feature will work without errors;
• All information will be accurate;
• Uploaded content will never be lost;
• Every service will work on every device; or
• A service will meet every user's particular needs.

Nothing in these Terms removes any warranty or consumer right that applicable law does not allow us to remove.

12. Limitation of Liability

To the fullest extent permitted by law, PutesLabs will not be responsible for indirect, incidental, special, or consequential losses resulting from your use of the services.

This may include lost profits, lost business, lost opportunities, lost data, or damage caused by an independent third party.

To the fullest extent permitted by law, PutesLabs' total liability relating to a service will not exceed the greater of:

• The amount you paid for that service during the 12 months before the claim; or
• $100.

These limitations do not apply to fraud, intentional misconduct, or another type of responsibility that applicable law does not allow us to exclude or limit.

13. Suspension and Account Termination

You may stop using our services at any time.

You may request account deletion through the applicable app or by emailing hello@puteslabs.com.

We may suspend or terminate access if we reasonably believe that:

• You violated these Terms;
• Your account is being used fraudulently;
• Your activity creates a security risk;
• Your activity may harm another person;
• Payment remains unpaid or is reversed;
• We are legally required to restrict access; or
• The service is being discontinued.

When reasonably practical, we may provide notice before terminating an account.

Account deletion does not automatically cancel subscriptions billed through Apple, Google, or another payment provider.

14. Apple App Store

When you download a PutesLabs app through the Apple App Store, Apple's standard End User License Agreement applies unless a different license agreement is displayed for that app.

These Terms are between you and PutesLabs. Apple is not responsible for operating, maintaining, or supporting a PutesLabs app.

Purchases, subscriptions, refunds, and use of the Apple App Store are also subject to Apple's applicable terms and policies.

15. Google Play

When you download a PutesLabs app through Google Play, these Terms are between you and PutesLabs, not Google.

Purchases, subscriptions, cancellations, refunds, and use of Google Play are also subject to Google's applicable terms and policies.

Google is not responsible for operating, maintaining, or supporting a PutesLabs app.

16. Privacy

Our Privacy Policy explains how we collect, use, store, and disclose personal information.

By using our services, you acknowledge that you have reviewed the applicable Privacy Policy.

17. Governing Law

These Terms are governed by the laws of the State of Missouri and applicable United States federal law, without regard to conflict-of-law principles.

Any court dispute that is permitted to proceed may be brought in a court with proper jurisdiction in Missouri, unless applicable consumer law gives you the right to bring the dispute somewhere else.

Nothing in these Terms removes legal rights that cannot be waived under the laws where you live.

18. Changes to These Terms

We may update these Terms when our services, business practices, or legal obligations change.

We will update the "Last Updated" date when changes are made. For significant changes, we may provide notice through the app, website, or email.

Your continued use of the services after updated Terms take effect means you accept the revised Terms, to the extent permitted by law.

19. General Terms

If one part of these Terms is found unenforceable, the remaining sections will continue to apply.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights under these Terms without our permission. PutesLabs may transfer these Terms if the company, an application, or related assets are sold or reorganized.

These Terms and the applicable Privacy Policy form the agreement between you and PutesLabs regarding the services.
